IHLIA Open Up! is committed to making its constantly growing collection of LGBT material in the Content freely available to researchers, historians, scholars, and others for purposes of benefit to the public. IHLIA Open Up! offers different levels of access (tiers) to the Content, i.e. online, and offline, on site (on the premises of the IHLIA office). IHLIA Open Up! endeavours to enforce its terms of use and maintain (at minimum) standard computer security.

 

IHLIA Open Up! collects personal and statistical information from its Users. IHLIA Open Up! processes this information to produce anonymous, collective results regarding its Services, for internal purposes. When you register we ask for personal and contact information such as your full name, date of birth, and e-mail address. When you register and sign in to our Services, you are not anonymous to us. IHLIA Open Up! collects, receives and records information on server logs from your browser, including your IP address, cookie information, and the Content page you request. This information serves internal purposes and will not be shared with others.

 

IHLIA Open Up! may collect personal information when a Researcher registers for access to the Content, including the Researcher’s name, address, telephone number, and e-mail address, date of birth and the Researcher’s proposal for using the Content. IHLIA Open Up! uses this information for the following purposes: fulfil your requests services, improve our services, contact you in regard to our services, conduct research, and provide anonymous reporting (User statistics) for internal use. The information will not be shared with others.

 

IHLIA Open Up! does not rent, sell, or share personal information about you with others except to provide services you have requested, when we have your permission, or under the following circumstances: we respond to subpoenas, court orders, or legal process; or to establish or exercise our legal rights or defend against legal claims; when we believe it is necessary to share information in order to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of our terms of use, or as otherwise required by law.

 

In case of a non-anonymous file that results in data that contains personal data of third parties, the data shall not be made freely accessible via the IHLIA Open Up! Website. IHLIA Open Up!, however, considers it in the interest of science that this data is also archived and made accessible for research. Access according to so-called tier 3 (“Restricted”) applies to non-anonymous data. When using the data as described in the previous sentence, qualified Users are required to take account of the Dutch “Regulations for use of personal data in scientific research [4]” (“Gedragscode voor gebruik van persoonsgegevens in wetenschappelijk onderzoek” of the VSNU). Furthermore, for making data accessible that contain special personal data, such as data concerning religion, race, political opinion, criminal records or health, it is required that the licensor demonstrates that the parties concerned have given their consent for the archiving of their data and making these available by IHLIA Open Up! for statistical and scientific purposes. If the licensor cannot demonstrate this consent, the data shall only be accessible under very strict conditions, which, in accordance with Article 23 of the Dutch Personal Data Protection Act (WBP – Wet Bescherming Persoonsgegevens), imposes further requirements as to the nature of the scientific research, for the benefit of which the use of the dataset is considered necessary.
